The trick isn’t doing the impossible work; it’s doing the routine work without the routine errors that get filings kicked back.
Where the official forms live
Every state has its own forms, and using third-party templates instead of the state’s official versions is the most common DIY mistake. Where to look first:
- Your state’s judicial branch website. Usually courts.state.[xx].us or [state]courts.gov. Almost always has a "self-represented" or "forms" section with current PDFs.
- Your county clerk’s office. Some counties customize state forms or have additional local requirements.
- State legal-aid organizations. Often maintain plain-English packets that include forms plus instructions.
- The court’s self-help center. Many family courts have an in-person self-help center; staff can hand you the right packet and answer procedural questions.
Search "[your state] divorce forms court" rather than trusting the first Google result. Many third-party sites sell templates that look official but aren’t.
The core documents
For an initial divorce filing, most states require some combination of:
- Petition for Dissolution of Marriage (or "Complaint for Divorce")
- Summons — issued by the clerk
- Civil cover sheet — single-page case identifier
- Financial declaration or income/expense affidavit
- Proof of residency affidavit or built-in declaration
- Marriage certificate copy
- Initial parenting documents if you have minor children
- Filing fee or fee-waiver application
The exact list varies by state and by whether kids and significant assets are involved.
Filling the forms
Principles that consistently help:
- Match every name, date, and address across every form. Inconsistencies are the most common rejection trigger.
- Use the legal name from the marriage certificate. Not nicknames, not preferred names, not abbreviated versions.
- Be precise with dates. Marriage date, separation date, kids’ dates of birth — exact, formatted consistently.
- Don’t leave blanks. Use "N/A" or "Not applicable" where a question doesn’t fit. Empty fields look incomplete; "N/A" looks intentional.
- Sign in the right places. Most forms have multiple signature lines. Missing one is a rejection trigger.
- Notarize where required. Financial declarations and certain affidavits often need notarization.
The financial declaration
The single document that gives most filers trouble. It asks for:
- All income sources, by month
- All monthly expenses, by category
- All assets — accounts, real estate, vehicles, business interests
- All debts — mortgages, credit cards, loans
A few tips:
- Be comprehensive. Omissions look like concealment, even when they’re just oversights.
- Use exact balances as of a specific date. "$48,732.17 as of 2026-05-15" is stronger than "approximately $50,000."
- Attach supporting statements if the form permits.
- Don’t round to favorable numbers. Precision in both directions looks honest.
E-filing vs. paper
Most states have moved to electronic filing, sometimes mandatory.
A few tips for e-filing:
- Convert documents to PDF before uploading; portals often won’t accept Word documents directly.
- Combine multi-page documents into single PDFs where required.
- Pay attention to file-naming conventions — some portals require specific naming.
- Save the confirmation receipt; it’s your proof of filing.
Home setup: the supplies you need before you need them
Pro se filing is a small home-office discipline, not a couch-and-laptop posture. The most common failure mode for self-represented filers isn’t legal — it’s logistical. Deadline tomorrow, printer broken, post office closed.
The minimum kit: a working printer with a spare ink or toner cartridge, a stack of plain paper, a box of manila envelopes, a stamp source or postage-meter app, a scanner or a phone scanning app that exports clean PDFs, and folders or accordion files for your own copies.
Know your local backup before you need it. Your nearest post office’s hours, including weekends. Public libraries print for cents per page when your home printer dies. UPS Stores and FedEx offices do notarization, in case a financial declaration needs notarizing the day it’s due.
The common rejection triggers
First-time filers see the same rejections repeatedly. Avoiding these saves weeks:
- Missing signatures. The most common cause.
- Wrong venue. Filed in the wrong county.
- Missing required attachments. Each state has its own list; missing one sends the whole packet back.
- Inconsistent information across forms. Names spelled differently, dates that don’t match.
- Incorrect fee. Wrong amount, or no fee-waiver application when one was needed.
- Notarization missing where required.
- Outdated form versions. Forms get updated; using a 2023 version of a form that was revised in 2025 is a common DIY error.
When DIY works vs. when an attorney earns the fee
DIY documents work well for:
- Short marriages with no kids and minimal assets
- Uncontested cases where the parties agree on everything
- States with strong self-represented programs
- Filers comfortable with detailed forms and willing to read instructions carefully
DIY documents don’t work well for:
- Cases involving significant assets, especially businesses or out-of-state property
- Contested cases — the moment the other side has an attorney, DIY exposes you to procedural disadvantage
- Custody disputes that need anything beyond a routine schedule
- Cases with complex tax issues, retirement-account splits, or business valuations
- Anyone uncomfortable with the procedural detail
A common middle path: pay an attorney for two or three hours to review your documents before filing. The cost ($500–$1,500) catches most errors and surfaces issues a DIY filer wouldn’t notice.
After filing
Once the clerk accepts the petition, the case officially exists. The case number is assigned, the summons is issued, and the procedural clock starts. Your next steps:
- Serve your spouse with the documents
- Wait for the response deadline
- Track the schedule of next steps the court provides
The forms work, the filing accepts, the case starts. From here it becomes a procedural matter rather than a paperwork one.
